Troy Ave won't be facing murder charges in the aftermath of the May 25 shooting incident at Irving Plaza in New York that left three wounded and one man dead. According to TMZ, Troy, born Roland Collins, was hit with five charges, all serious felonies, but wasn't charged with murder.

Legal docs obtained by TMZ indicate that a grand jury has indicted Troy on one count of attempted second degree murder and four counts of criminal possession of a weapon.

The rapper's bodyguard, Ronald McPhatter, was killed during the shootout last month, which occurred backstage at a T.I. concert. It appears that ballistic testing did not match the weapon Troy was seen firing that night on video footage that surfaced shortly thereafter.

"The video does not show everything nor explain what happened in the VIP room before Troy came running out, as a victim, after he was shot," explains Troy's attorney, Scott Leemon.

Last week, Troy unveiled a scholarship at the high school he and McPhatter attended together; it's an athletic scholarship at New Utrecht High School. The scholarship will provide $2,000 a year to an exceptional individual for five years.

Leemon is expected to request that Troy be released on bail at his next hearing later this week.
