Although Keyshia Cole won't face prosecution for beating up a woman at Birdman's Los Angeles penthouse, the victim herself is fighting back with a lawsuit.

Sabrina Mercadel, the woman Cole allegedly pummeled, has filed a lawsuit against the R&B singer for attacking her last September.

In her suit, Marcadel, who is an employee of Cash Money Records, claims that Cole accused her of having sex with Birdman when the incident happened. The victim maintains that she and Baby have a "strictly platonic" relationship.

The lawsuit also states that Mercadel suffered scratches on her face and bruises from the assault. To add insult to injury, Cole insinuated that she was a prostitute by slapping her butt and telling her, "You can get your money later."

Mercadel is being represented by the law firm founded by the late attorney Johnny Cochran. They insist that their client was not in a romantic relationship with the rap mogul. No word on how much Mercadel is seeking in damages.

Reps for Keyshia Cole had no comment on the matter.
